All reservations require the Guest to verify their ID, if this is not done in a timely manner the reservation is subject to cancellation. The minimum age to rent is 25. Any misrepresentation will result in you being asked to vacate the property. The person signing this Agreement represents that they have the authority to sign on behalf of all guests staying at the Property and in doing so all guests shall become legally bound by this Agreement.  

Violation of any of the terms of this Agreement may include additional charges, cleaning fees, or immediate termination of occupancy without refund. No Guest alterations to this contract will be accepted without our written consent. Guests are subject to other reasonable Rules and Regulations that may be provided at the Property.

·        Check in time is 4:00pm or later.

·        Check out time is 10:00 am. 

·        Early check-in or late check-out may be granted on a case-by-case basis and will be subject to an additional fee.   

·        Failure to depart by 10:00 am may result in additional rental fees, plus any charges incurred by Rental Agent by our third-party service providers. 

 

OCCUPANCY:  Maximum of 2 people per bedroom, no exceptions. You agree to provide an accurate count of Guests.  The premises shall not be occupied by any person other than those designated below as Guests. If this number changes it needs to be pre-approved, prior to arrival.    

 

CONDITION OF PREMISES: Guest acknowledges, that immediately upon checking in, they will complete an inspection of the property.  If the Guest has not inspected the premises, Guest waives the right to withhold claim that the property has been misrepresented by Rental Agent. Both Guest and Rental Agent agree that to the best of their knowledge and belief, the Property will comply with the statutes, rules and regulations of governmental authorities. Guest agrees to complete the inspection and inform Rental Agent of any problems, defects or need for cleaning within 2 hours of check-in. Items noted on inspection shall not be subject to charges against the Guest. Guest promises to keep the premises in a neat and sanitary condition and to immediately reimburse Rental Agent for any sums necessary to repair any item or fixture that needs to be repaired or replaced due to Guest or misuse or negligence. The Property is rented to the Guest “as-is”. 

 

DAMAGE:  As a condition of your rental, you are expected to exercise care of the Property during your stay. If you damage or break something, discover something is broken, not working properly, or if you discover a hazardous condition, report it to the property manager or Rental Agent immediately. Should anyone in your group break, damage, or cause something to be broken or damaged in the Property, you will be held responsible for it. Inform Rental Agent immediately to arrange for repair or replacement. Costs incurred for unreported damage discovered after you have left the property may be charged to the Guest. Guest agrees to pay for any damage to the property, missing or damaged items, as well as a commercially reasonable additional cleaning fee if left excessively dirty or if posted check out procedures are not followed. 

 

Guest shall be responsible for the cleaning or repair to any plumbing fixture where a stoppage has occurred due to any foreign object. Guest shall also be responsible for repair or replacement of the garbage disposal where the cause has been a result of bones, grease, pits or any other item which normally causes blockage of the mechanism.

 

WAIVER: The Guest agrees that Rental Agent shall not be liable to Guest or any other person for any injury, loss or damage to any person or property on or about the rental premises. Guest and their invitees, shall hold Rental Agent and Rental Agent’s employees and contractors harmless and indemnified from and against all loss or damage occasioned by use, misuses or abuse of any part of or fixture on the premises, surrounding areas of Property and from or against any omission, neglect, or default of the Guest his/her guests or invitees.

 

NOISE AND DISRUPTIVE ACTIVITIES: Guest shall not disturb, annoy, endanger or inconvenience other guests of the building, neighbors, the Rental Agent or Rental Agent’s agents, or workmen, nor violate any law, nor commit or permit waste or nuisance in or about the premises. Further, Guest shall not do or keep anything in or about the premises that will obstruct the public spaces available to other residents.

 

Rental Agent will make every effort to ensure that Guest’s stay is safe, comfortable, and enjoyable. No refunds or discounts will be made for inclement weather, mechanical breakdowns, or other “nuisances” beyond our control except as required by law.  Examples of “nuisances”, which DO NOT warrant any refund or discount include but are not limited to: breakdown of TV's, DVD players, electronics or appliances, construction in the area, disruption of utility services, internet outage, problems not reported to manager, bad weather, or noisy neighbors. Guest agrees to report any and all problems to Rental Agent immediately.  Rental Agent agrees to make every effort to resolve the problem as quickly as possible, however, we cannot guarantee when the problem will be resolved.

 

ACCESS: Guest agrees to allow access to the premises for work to be performed by Rental Agent or Rental Agent’s agents.

 

PETS: No pets are allowed on premises unless the pet has been approved in advance in writing by Rental Agent.  If an unapproved animal is found to be in the Property, all Guests will be immediately evicted and will not be reimbursed for any unused days and the Guest will be subject to additional reasonable cleaning fees. An additional non-refundable fee of $50 per night, per pet will be charged. There is a maximum of two pre-approved, pets. 

 

SMOKING: No smoking or vaping of any product. If smoking or vaping is observed in the Property, Guest will be immediately evicted and will not be reimbursed for unused days. NO EXCEPTIONS. If upon vacating unit the Property, tobacco odor is noted by Rental Agent’s agents, the Guest will be subject to additional reasonable cleaning fees.

 

HOT TUB:  Usage of the hot tub is at your own risk. If the hot tub is found to be excessively dirty upon check out, the Guest will be subject to additional reasonable cleaning fees. No refunds will be issued for hot tub down time.

 

POSSESSION: If the Property cannot be delivered to Guest on the agreed date due to loss, total or partial destruction of the Property, or failure of previous Guest to vacate, either party may terminate this Agreement. It is acknowledged that either party shall have no liability to each other except that all sums paid to Rental Agent will be immediately refunded to Guest. No reimbursement will be made based on weather and/or mandatory evacuation. Travel insurance is strongly recommended.

 

LOST ITEMS: Rental Agent is not responsible for items left behind. We will use our best efforts to reach out to the cleaning crew to locate lost items and return found items to Guest, at Guest’s expense. 

 

RENTAL AGENT WAIVER: Rental Agent’s failure to require compliance with the conditions of this Agreement, or to exercise any right provided herein, shall not be deemed a waiver by Rental Agent of such condition or right. Rental Agent’s acceptance of rent with knowledge of any default under this Agreement by Guest shall not be deemed a waiver of such default, nor shall it limit Rental Agent’s rights with respect to that or any subsequent right.

 

CANCELLATION POLICY: 

 

a)      Bookings cancelled 90 days prior to arrival date:  A refund will be issued for cancellations submitted in writing 90 days or more prior to the start date of the reservation.  

b)     Bookings cancelled less than 90 days prior to arrival are non-refundable.  Manager or Rental Agent will make every attempt to re-book to an acceptable group for the same time period and at the same rate. If they are able to do so, you will receive an appropriate refund. 

c)      Rental Agent reserves the right to issue traveler a future credit in the case of a government order or restriction that makes the property unusable or inaccessible.

d)     Cancellations must be in writing if booked directly with Rental Agent. Bookings made through a third-party booking agent must be canceled through their system.  

e)      No refunds for early departure, or late arrival.

f)      If the Property is unacceptable to you, this is considered a non-refundable cancellation.

g)     If reservation was secured through a booking site, they may charge you a service fee. Site service fees are specifically excluded from our refund policy and our contracts; service fees are solely between Guest and booking site. 

h)     Failure to submit payments on time will result in cancellation of reservation without refund or recourse.

i)       Rental Agent reserves the right to cancel this reservation for unforeseen circumstance, act of God or any situation that makes the property unusable. You will then receive a 100% refund of money paid to us. There will be no other money given for damages, consequential losses, or expenses.

 

NO REFUNDS: There are no refunds for unforeseen or unfortunate events, including but not limited to unexpected events such as death, illness, injury, and catastrophic events such as pandemics, “Stay at Home Orders”, evacuations, government orders, earthquakes, hurricanes, fires, flood, travel restrictions and bans, border closures, grounded flights, civil unrest, protests, war or terrorism. Rental Agent reserves the right to issue traveler a future credit under exceptional conditions. 

 

TRAVEL INSURNANCE: Guests should consider purchasing additional appropriate travel coverage. We suggest you consider an upgraded “Cancel Anytime” policy. Every policy differs. Please read your clauses carefully to ensure they meet your personal needs and requirements.

 

MISCELLANEOUS: This Agreement contains the entire agreement between the parties with regard to the rental of the Property, and any changes, amendments or modifications hereof shall be void unless the same are in writing and signed by both the Guest and the Rental Agent. The words “Rental Agent” and “Guest” shall include their respective heirs, successors, representatives.

 

The waiver or failure to enforce any breach or provision of this Agreement shall not be considered a waiver of that or any other provision in any subsequent breach thereof. If any provision herein is held invalid, the remainder of the Agreement shall not be affected. Any notice required to be given under this Agreement shall be in writing and sent to the contact information included herein. This Agreement may be signed in one or more counterparts, each of which is an original, but taken together constitute one in the same instrument. Execution of a digital signature shall be deemed a valid signature.
